Moonlight Sonata: five bank statements before the leave hearing

With the petitioners' application for leave to appeal set for October 27, AlixPartners' Fifth Report says the bank statements the debtors gave the project's cost consultant overstated a TD account's closing balance in each of the five 2025 months it checked, by $970,218.66 to $2,035,766.33. The principal, through counsel, says he was unaware of them.

The monitor asks the court on October 5 to approve Townline as construction and development manager, raise the interim borrowing limit to $7.5 million and extend the stay to December 18. Its Fourth Report adds a suspended building permit, terminated home warranty policies and a former sales representative's account of ten presales with $10,000 deposits.

Moonlight Sonata: the monitor lines up a builder, and a guarantor asks out

Six weeks after Justice Milman gave AlixPartners the powers of the board over a stalled 51-townhome first phase in Burnaby, the monitor has disclaimed the Symphony group's construction management contract, chosen Townline Construction to negotiate a restart and reported that the project's BC Housing builder licence expired on July 31, 2025. The stay now runs to October 9, and the petitioners want 663466 B.C. Ltd., the founder's holding company, out of the CCAA.
