KingSett is the senior secured lender to Vandyk – Uptowns Limited and is also the lender under the receivership borrowing facility secured by the Receiver's Borrowings Charge, which carries a $1,000,000 limit that the receiver has asked to raise to $3,000,000. Vandyk: a new declarant at Lakeview is not a material change

On September 29, 2026, Justice Jana Steele declared that KS Lakeview's acquisition of Vandyk's Lakeview condominium project from the receiver is not a material change under the Condominium Act, and that the respondent purchasers' purported notices of rescission are invalid. Their agreements had let the vendor assign them unilaterally.
