This Tenth Report is provided to this Court in support of a motion by the Receiver for an Order: a) approving the Tenth Report and the activities and the conduct of the Receiver described therein; b) authorizing and directing the Receiver to distribute the remaining proceeds from the sale of the RH Real Property to Kone, Weston, and Capital Drywall in respect of their non-priority lien claims, and to Chubb as assignee of nine of the thirteen accepted lien claims in respect of their non-priority lien claims; c) approving the agreement of purchase and sale of the Atlas RH Ltd. Mobile Independent Health Facility Licence (“IHF Licence”) to MyHealth Partners Inc. (“MyHealth”), authorizing the Receiver to enter into the agreement substantially in the form attached as Confidential Appendix “1” to the Tenth Report, and pending the closing of the transaction or further Order of the Court, sealing the unredacted agreement of purchase and sale for the IHF Licence and summary of offers, which will be filed separately as Confidential Appendices “1” and “2”. This first supplement to the Seventh Report (the “Supplementary Seventh Report” or “Supplementary Final Lien Report”) is to provide this Honourable Court with the Receiver’s evaluation of the Notice of Dispute of Pipe-All, and the Supplementary Notice of Dispute of General Sprinklers, and to advise of the impact of these parties’ claims on the Receiver’s recommendations in the seventh report of the Receiver dated April 20, 2020 (the “Seventh Report” or “Final Lien Report”) regarding the amounts of the lien claims of Pipe-All, General Sprinklers and Dineen.
