Pier 1 Imports, Inc. applied to the Ontario Superior Court of Justice on February 18, 2020 under section 46 of the Companies' Creditors Arrangement Act for recognition in Canada of its Chapter 11 cases, court file CV-20-00636511-00CL. As at the February 17, 2020 petition date the group carried US$376.3 million of funded secured debt: US$189,000,000 to the term loan lenders, agented by Wilmington Savings Fund Society, FSB, on a first lien over term priority collateral, and US$187,300,000 to the ABL lenders agented by Bank of America, N.A., which registered PPSA security against each Chapter 11 debtor other than PIR Trading, Inc. Holders of 63.8% of the term loan back a plan support agreement converting debt to equity, and a superpriority DIP facility of up to US$256 million was put forward.
