Peavey Industries General Partner Limited, together with TSC Stores GP Inc., Guy's Freightways Ltd. and Peavey Industries Limited, commenced CCAA proceedings in Alberta on January 27, 2025, and the case remains active. The filing followed the January 16, 2025 service of demand letters and notices of intention to enforce security under section 244 of the BIA by 1903P Loan Agent, LLC, as administrative agent, claiming $66,414,413.41 plus unquantified fees, costs and expenses from Peavey Industries LP under the 1903 Credit Agreement dated December 20, 2024. That facility, secured over substantially all assets and guaranteed by the corporate applicants, had refinanced and paid out the Royal Bank of Canada-agented syndicate in full. The applicants sought an Interim Lender's Charge of up to $15,000,000 for post-filing advances. Equipment and vehicle PMSI financiers were owed $9,091,738.21 as at November 30, 2024, and Origin Story Inc. held a subordinated related-party loan of $9,313,920 on the same date.
