New Century Greenhouses Ltd., together with King Greenhouse Ltd., Sunlight Greenhouse Ltd., Universal Greenhouse Ltd., Smart Greenhouse Ltd. and Sky Green House Ltd., has been before the Court of King's Bench of Alberta since July 28, 2026 under court file 2603 08746, on an application by Farm Credit Canada, the named applicant and plaintiff. The matter remains active. The receiver has obtained a security opinion from legal counsel confirming that FCC's security is valid and enforceable. The Canada Revenue Agency has filed deemed trust class proofs of claim of $199,887.92 against New Century Greenhouses Ltd., of which $98,540.69 is employee source deductions and $101,347.32 employer source deductions, and $81,834.41 against King Greenhouse Ltd., comprising $48,379.74 employee and $33,454.67 employer source deductions. Registered subsequent encumbrancers include CNH Industrial Capital Canada Inc. under a PPSA purchase-money registration, Iron Core Mechanical Ltd. under construction lien 261 024 421, Agriculture and Agri-Food Canada, Alberta Employment Standards and the Workers Compensation Board.

The Debtors' greenhouse operations are in receivership with the Receiver marketing and selling the real property: the Sky and New Century Premises are sold (New Century closed August 17, 2026), the equipment auction is expected to yield nothing, and the Receiver seeks approval of an auction agreement to sell the four remaining properties.

The court granted an approval and vesting order for the sale to all of the Debtors' right, title and interest in and to the assets described in the Auction Agreement (the "Auction Assets"). Closing terms, as extracted: Upon the closing of the transaction contemplated in the Auction Agreement, and the remittance of the net sale proceeds to the Receiver as contemplated in the Auction Agreement, the Receiver shall file with the Clerk of the Court a Receiver's Certificate.

Case update
New Century Greenhouses: four greenhouses to auction, and a seventh in Tisdale
Two of the six Redcliff greenhouses have sold and the receiver expects its equipment auction to realize nothing; on September 14 the receiver asked the court to hand the other four to McDougall Auctioneers against a sealed net minimum guarantee, with bidding to close on or about November 13. Farm Credit Canada, owed $3,068,060.70 on the six as of April 17, has meanwhile applied to put a seventh greenhouse, near Tisdale, Saskatchewan, into the same receiver's hands.
Case update
New Century Greenhouses: twelve vehicles, by serial number
Six commercial greenhouses around Redcliff, Alberta went into receivership on May 5. Seven weeks later the receiver still did not have the bank statements, the payroll records, or the keys — so on June 29 it obtained an order compelling the companies and their three guarantors to produce all of it within ten days, down to the location of twelve vehicles listed by VIN.
