KidKraft, Inc., together with Solowave Design Holdings Limited, Solowave Design Inc., Solowave International Inc. and Solowave Design LP, was before the courts of Ontario on a foreign recognition application under Part IV of the Companies' Creditors Arrangement Act, R.S.C. 1985, c. C-36, as amended, and section 106 of the Courts of Justice Act, R.S.O. 1990, as amended. The file proceeded in Ontario on that cross-border footing, with the CCAA's Part IV recognition provisions and section 106 of the CJA supplying the statutory basis for the relief sought.
