Fun Park Amusement Center Ltd., Fun Park Amusement Center (Winnipeg) Ltd. and City Wide Entertainment Group Inc. are the subject of an active court-appointed receivership in the Court of King's Bench of Alberta, court file 2003-14690, brought by Royal Bank of Canada under section 243(1) of the Bankruptcy and Insolvency Act, section 13(2) of the Judicature Act and section 65(7) of the Personal Property Security Act for the appointment of a receiver and manager. RBC puts the total debt at $2,311,769.88 as at February 1, 2021, net of a $125,000 payment received under a forbearance agreement: $271,007.12 owing by Fun Park EDM, accruing interest at $2.95 per diem; $1,987,245.47 owing by Fun Park WPG, accruing at $315.99 per diem; and $53,517.29 in billed legal fees as at January 31, 2021. The bank relies on general security agreements dated August 15, 2016 and June 23, 2017, registered on the Alberta and Manitoba personal property registries, an April 15, 2017 chattel mortgage, a progress payment agreement over the leaseholds and equipment at 1175 Wilkes Avenue, and City Wide guarantees capped at $755,000 and $1,290,000.
