Amsen Quarry Limited and Certain Equipment of Royal Canadian Bedrock Inc. (Receivership)

Amsen Quarry Limited is in court-appointed receivership in the Ontario Superior Court of Justice (Commercial List) under file CV-18-00595177-00CL, together with certain equipment of Royal Canadian Bedrock Inc., following an interim order granted September 12, 2018 on the application of Kooy Brothers Lawn Equipment Limited. The Fuller Landau Group Inc. is receiver. Kooy claims an approximate $549,841.65 from Amsen and an approximate $851,134.63 from Royal Canadian Bedrock as at March 30, 2018, plus accruing interest and costs, secured by PPSA registrations over leased equipment and a collateral mortgage on the quarry at 136 The Bury Road, South Bruce Peninsula. Default was alleged from March 2015 and again in July 2016, with section 244 notices issued June 15, 2017 and February 26, 2018. The quarry carries more than $50,000 in municipal tax arrears secured by liens and is subject to a final notice of pending tax sale, and multiple related-party mortgages, including a third-ranking mortgage assigned in December 2017, are to be investigated by the receiver.
