The purpose of the First Report is to: (a) provide a brief background and overview of the situation with the Debtors prior to the Receiver’s appointment; (b) report on the activities of the Receiver since its appointment; (c) report on the conduct of the Debtors regarding production of the Debtors’ books and records in compliance with the Appointment Order; (d) update the Court with respect to the pre-receivership agreement of purchase and sale entered into for the property located at 1500 Birchmount Road, Toronto (the “Birchmount APS”), and the status of the litigation over the deposit paid in respect of the Birchmount APS; and (e) provide the evidentiary basis to make an Order approving the activities of the Receiver as described in the First Report
