Explorer Marine Partners Ltd. and Bluewater Rigging Ltd. have been in receivership since February 16, 2023, when the Supreme Court of British Columbia appointed MNP Ltd. as Receiver and Manager on the application of the Canadian Imperial Bank of Commerce under section 243(1) of the Bankruptcy and Insolvency Act and section 39 of the Law and Equity Act, court file S231107. CIBC holds all-assets security over both companies for $1,440,000; Wells Fargo Capital Finance Corp. Canada holds all-assets security over Explorer, and Andrew and Lindsey Macdonald and the Garrod Family Trust hold all-assets security over Bluewater, with several lenders holding specific motor vehicle security. CRA asserts deemed trust claims of $105,000 in source deductions and $35,000 in GST against Bluewater. The Receiver estimates realizable value of $200,000 for inventory and equipment and $60,000 for a boat. The proceeding remains active.
