Nielsen of the Court of King's Bench of Alberta granted an order on the application of senior secured lender Otéra Capital Inc. (Court File No. 2503-13149). Otéra's indebtedness was stated at $139,508,037.26 as at June 1, 2025, plus accruing interest and costs, secured by a mortgage registered November 26, 2019 with original principal of $155,500,000. ECC had been in default since December 1, 2024; a forbearance agreement was reached February 21, 2025, and demand and a notice of intention to enforce security followed on June 16, 2025. Construction liens registered by Chancelot Concrete Restoration ($366,376), Clay Consulting ($214,161.68) and United Rentals ($68,731) stand against the lands; the Receiver's preliminary position is that Chancelot's lien ranks behind the Otéra mortgage.
