Chancery (Oshawa) The Bartlett Limited Partnership and Chancery (Oshawa) the Bartlett GP Inc. have been under court-appointed receivership since July 20, 2023, in the Ontario Superior Court of Justice (Commercial List) under file CV-23-00700694-00CL, on the statutory footing of BIA s. 243 and the provincial Judicature Acts. The proceeding follows the maturity of credit facilities from Fiera FP Real Estate Financing Fund, L.P., extended under a commitment letter dated November 25, 2020, as amended. The loan matured March 31, 2023 and was not extended, with interest, fees and costs continuing to accrue. The principal sum is $53,250,000, which includes an interest reserve of $3,185,000; Fiera's application materials put the amount owing at approximately $54.6 million as of June 2, 2023 on the same underlying debt. Fiera's security includes a mortgage registered on title to 550 Bond Street West, Oshawa, and a PPSA registration. The proceeding remains active.
