Brightpath Capital Corporation has been under court-appointed receivership in Ontario since April 10, 2026, on an appointment made under subsection 243(1) of the Bankruptcy and Insolvency Act and section 101 of the Courts of Justice Act. The receiver has reported twice, on June 1 and June 23, 2026, and the court granted orders on June 5 and June 24, 2026. The business has continued to operate in the normal course under the receiver's supervision and at its direction, save that the debtor no longer originates mortgages, consistent with an intended orderly wind-down. Receiver activities to date include servicing mortgage loans, negotiating Revised Servicing Agreements, advancing power of sale proceedings, freezing and establishing bank accounts, engaging Kroll Associates for data preservation, issuing notices under BIA sections 245 and 246, and facilitating payroll.

Case update
Brightpath: two groups of noteholders, and a contest over who speaks for them
A mortgage lender's book is realising in dribs and drabs and will not repay its senior lender in full. The receiver has been authorised to give information to the Ontario Securities Commission. And the noteholders — who moved for a receiver before the senior lender did, and who asked that the order include the power to bankrupt the company to preserve a look-back period — are now split into two camps with a motion pending over which of them gets an official committee.
