The Company continues operating its construction projects while facing new construction liens (including the Vanauley Lien) that may reduce forecasted cash receipts and complicate a planned $1.5 million paydown of the secured revolver; the Proposal Trustee supports appointing GlassRatner as Interim Receiver, though it does not currently intend to take possession or control of the Company's property.

Assembly continues to operate its construction business in the ordinary course, working through project delays and disputes, negotiating direct payment arrangements with customers and project creditors, and pursuing new financing while reducing staff levels.

Assembly Corp: a lender's receivership on the owners' terms
PaceZero wanted a skinny realization order over Assembly Corp. and two sister companies; on August 11 Justice Black granted the receivership on the project owners' stabilization terms and declined, for now, to give Thunder Woman Healing Lodge a unilateral right to terminate its contract. Assembly was deemed bankrupt the next day, with a $22,629,045.80 deficiency.

Assembly Corp: the liens come off title
Four Toronto affordable and supportive housing projects — owned by the Elizabeth Fry Society, Thunder Woman Healing Lodge, the YMCA and WoodGreen, and between 50% and 95% built — stopped when their builder filed a notice of intention and the trades registered liens. On August 11 Justice Black vacated every registered lien from title and replaced them with charges over project-specific security funds.

Assembly Corp: an interim receiver as the price of a stay extension
The senior secured creditor would support the debtor's first stay extension on one condition — that the proposal trustee also be appointed interim receiver. The resulting order takes no possession and controls no property. It gives the same firm the power to approve every disbursement. And a separate provision lets the company pay out Construction Act trust money to subcontractors, including trusts that arose before the filing.
