Ashcroft Homes Group has been under interim receivership since December 20, 2024, when the Ontario Superior Court of Justice appointed KSV Restructuring Inc. as Interim Receiver over eight related companies, including Ashcroft Urban Developments Inc., Ashcroft Homes – La Promenade Inc. and Ashcroft Homes – Capital Hall Inc., on the application of ACM Advisors Ltd. The order was made under section 47(1) of the Bankruptcy and Insolvency Act and section 101 of the Courts of Justice Act, and included a stay of proceedings. KSV filed its First Report on February 14, 2025, reporting on cash management, insurance, mortgagee correspondence and oversight of the companies' businesses with property managers Brightwater and Varsity. The proceeding remains active under court file CV-24-00098058-0000.
The court granted an approval and vesting order for the sale to 1000747194 Ontario Inc. Closing terms, as extracted: Sealed items remain confidential until the earlier of 60 days following closing of the Transaction, or further Order of the Court; vesting effective upon delivery of Receiver's Certificate confirming payment of purchase price, satisfaction/waiver of closing conditions, and completion of the Transaction.
