Aclarus Inc. has been in receivership since January 29, 2024, when Rosen Goldberg Inc. was appointed receiver under subsections 245(1) and 246(1) of the Act. The Bank of Montreal, owed $845,959, holds a general security agreement dated April 26, 2013 registered under the Personal Property Security Act as financing statement no. 20130424 1340 1532 3557 and twice renewed, expiring April 24, 2028, over inventory, equipment, accounts, a motor vehicle and other collateral. An independent legal opinion from Miller Thomson dated January 25, 2024 confirmed the security is validly perfected and enforceable against the trustee. The receivership remains active in Ontario.
