1639329 Ontario Ltd. has been in court-appointed receivership since July 16, 2013, when the Ontario Superior Court of Justice appointed SF Partners Inc. receiver on the application of Ontario Wealth Management Corporation under section 243(1) of the Bankruptcy and Insolvency Act and section 101 of the Courts of Justice Act. Ontario Wealth Management held a first charge with a principal of $1,800,000 and a second charge with a principal of $300,000, together with a general security agreement and assignment of rents both dated June 13, 2006, and its claim stood at $2,091,863.11 as at October 27, 2014. Independent counsel at Harrison Pensa LLP confirmed that security as valid and enforceable, and the receiver reports the applicant will suffer a shortfall. The Ontario Minister of Revenue registered a $590,009.69 writ claim that is subordinate to it under section 87(2) of the Act.
