Longview Logistics: 21 trailers, one seized in Texas, and a settlement

National Bank had BDO appointed receiver of 21 Vanguard trailers in October 2025; none was at the companies' Centreport premises, and the one located since was seized by Texas Highway Patrol. BDO now asks the court to approve the companies' settlement with the bank, its sum in a confidential supplement, and to discharge BDO.

On October 8, 2025, Justice Grammond of Manitoba's Court of King's Bench appointed BDO Canada Limited receiver of 21 Vanguard trailers Order (Appointing Receiver), Oct. 8, 2025, para. 2. BDO went that day to the head office of the two companies they were leased to, 10047277 Manitoba Ltd. and Longview Logistics Ltd., a long-haul trucking and transportation business based in Centreport, Manitoba. None of the trailers was there. Two of the companies' principals met BDO and "continued to maintain the position" that the companies no longer had them, because National Bank of Canada, the bank that had applied for the receivership, had already repossessed them. BDO could not take possession that day, and with the trailers nowhere on site it did nothing further at the premises, per the First Report of the Receiver, Oct. 29, 2026, paras. 13, 15–16 and the Notice and Statement of the Receiver, Oct. 17, 2025, para. 4.

In the year since, one of the 21 has been located, by Texas Highway Patrol, east of Amarillo. What BDO brings back to Justice Grammond on November 9, 2026 is a settlement between the bank and the two companies, paid into trust in October, whose sum the public filings leave to a confidential supplement that BDO asks the court to seal. The motion also seeks an order paying the settlement funds to the bank, less a holdback, and discharging BDO, per the Notice of Motion, Oct. 29, 2026, relief, para. 1 and the First Report of the Receiver, Oct. 29, 2026, paras. 18, 24.

The bank's trailers, and two accounts of where they went

The trailers are "owned by NBC", the receiver's motion says, per the Notice of Motion, Oct. 29, 2026, grounds, para. 10. CWB National Leasing Inc. leased equipment, the 21 Vanguards among it, to 10047277 Manitoba under a master lease of March 14, 2022, which the bank's affidavit summarizes as providing that the equipment "is and will at all times be NBC's property"; an affiliate lease let the numbered company lease equipment on to Longview, which guaranteed the leases. CWB amalgamated with National Bank of Canada on March 1, 2025, per the NBC affidavit, Sept. 25, 2025, paras. 2, 6–9.

The bank's affidavit says the companies defaulted on their lease payments, and that it demanded payment by letter dated November 7, 2023 and on November 15 served a notice of intention to enforce security under s. 244 of the Bankruptcy and Insolvency Act. Its bailiff, Central Collection Service, seized all of its collateral except the 21 trailers, the affidavit says, and between December 2023 and January 2024 the bank seized and sold equipment at auction and applied the net proceeds to the debt. As of May 9, 2025 it put what remained owing under the master lease at $1,807,050.60, interest included. In August 2024 it sued both companies in the Court of King's Bench, File No. CI 24-01-48005, for judgment and for "the recovery of the Vanguard Trailers", per the NBC affidavit, Sept. 25, 2025, paras. 14–17, 19, 27.

The bank's affidavit says Central Collection searched for the trailers in Manitoba and through contacts in Saskatchewan and North Dakota, and that a second firm, between March 4 and April 17, 2025, attended the companies' business locations in Winnipeg, Calgary and Edmonton, without finding one. It says that "at no time has NBC or its agents repossessed the Vanguard Trailers as alleged", per the NBC affidavit, Sept. 25, 2025, paras. 22–25.

The companies' statement of defence in the lawsuit, attached to the bank's affidavit, gives the other account. It says a bailiff attended in or about January 2024 and "instructed the Defendants to park all trailers in the yard … located at 235 Goldenrod Drive, Rosser, MB for collection", that the companies complied and gave the bailiff access, and that the 21 trailers "have been repossessed by the Plaintiff and/or an agent of the Plaintiff in or about April 2024". The companies did not deny the bank's right to immediate possession; they denied having the trailers, per the NBC affidavit, Sept. 25, 2025, Ex. "O" (Statement of Defence), paras. 7, 11–12. The affidavit one of their principals affirmed in reply to the receivership application says all of the trailers were collected and stored at the Goldenrod Drive yard from the end of February to the beginning of April 2024, and that the companies cancelled the trailers' Manitoba Public Insurance registration and insurance because, with the trailers "to be taken by the Applicant", any insurance "would be a sunk cost". On or about June 4, 2025, it says, the companies filed a police report with the RCMP "pertaining to the theft/loss of the Vanguard Trailers from the Sites", per the Respondents' affidavit, Oct. 8, 2025, paras. 11–12, 16.

A receiver for 21 trailers

The bank's notice of application, issued September 24, 2025, asked for a receiver "in a limited capacity only with respect to the Vanguard Trailers", the receivership "intended to be temporary until the Vanguard Trailers are located and sold". Private bailiffs in Manitoba and Alberta had not found the trailers, the application says, and a receiver was "the only reasonable option available to NBC", per the Notice of Application, Sept. 24, 2025, paras. 21, 23–24.

Resisting it, the companies' affidavit said a receivership order "will be detrimental to the business of the Respondents", would become public knowledge and would leave "customers and brokers" hesitant to deal with them; the bank could obtain its relief without one, and the companies were willing to work with it toward "the joint goal of locating and selling the Vanguard Trailers", per the Respondents' affidavit, Oct. 8, 2025, paras. 18–19, 24–25.

The application came before Justice Grammond on October 1 and was adjourned at the request of the companies' counsel, per the First Report of the Receiver, Oct. 29, 2026, para. 1. It was heard on October 8, 2025, with counsel for both sides making submissions. The order made that day appoints BDO receiver, "without security, of the Vanguard Trailers", under s. 243(1) of the BIA and s. 55 of The Court of King's Bench Act, and empowers it to take possession of the trailers and sell them, including by public auction without further approval, per the Order (Appointing Receiver), Oct. 8, 2025, recitals and paras. 2–3. The rest of the companies' business lay outside the order, and they kept operating, per the Notice of Motion, Oct. 29, 2026, grounds, para. 3.

East of Amarillo

BDO corresponded with Samsara, "believed to be the provider of global positioning system … fleet tracking services to Longview"; with Manitoba Public Insurance; with the bank's former bailiff; and with the RCMP, to have the trailers listed as "potentially stolen" vehicles in the Canadian Police Information Centre database, per the First Report of the Receiver, Oct. 29, 2026, para. 17.

On or about November 19, 2025, a Texas Highway Patrol trooper contacted BDO: one of the 21 had been located and seized east of Amarillo, Texas. "At the time of the seizure, the Seized Unit had U.S. license plates and a modified VIN," the report says, and the patrol validated the correct vehicle identification number with the help of the manufacturer, Vanguard, per the First Report of the Receiver, Oct. 29, 2026, para. 18. The patrol had called because a search of the number flagged the trailer as "potentially stolen", a result of BDO's CPIC listing. It told BDO that a Texas court hearing would determine ownership but had not been scheduled, because the trailer "was related to a broader investigation being undertaken by THP and other law enforcement agencies", per the First Report of the Receiver, Oct. 29, 2026, para. 19.
