The house at 241 Patterson Street North in Beeton is a single-family home of about 1,370 square feet on a 75-foot by 148-foot lot, and the tenant who lives there has raised concerns about its condition. The receiver engaged a general contractor to investigate. "At this stage, the Receiver understands that there are significant concerns relating to mould throughout the property, where remediation appear to be disproportionate to the value of the property," TDB Restructuring Limited says in its first report, dated September 30. It is considering the best way to address these issues and will update the court in its next report, per the First Report of the Receiver, Sept. 30, 2026, paras. 9(a), 23.
That house is one of seven single-family homes across the eight addresses in this receivership, four of which the receiver has confirmed are occupied by tenants. Around them, in the report's description, the land is primarily vacant. Rent attornment letters have directed the tenants to pay the receiver, which has since dealt with roof leaks and with repairs relating to water treatment systems at certain of the tenanted houses, per the First Report of the Receiver, Sept. 30, 2026, paras. 9, 20–22.
The seven debtors are project-specific companies associated with Flato Developments Inc., a developer and homebuilder that has operated in Ontario since 2005. Dorr Capital Corporation, which sought the receivership, was owed approximately $29.1 million under its loans to them as at June 5, excluding certain legal and other third-party costs, per the First Report of the Receiver, Sept. 30, 2026, paras. 7, 11, 16. Justice Dietrich appointed TDB as receiver on June 23, per the Appointment Order, June 23, 2026, para. 2; the appointment was reported here the next day. The First Report is the receiver's account of the months since. With it comes a motion, returnable October 6, asking the court to approve two sale processes that between them cover all of the land: CBRE Limited for the EcoPark property at 772060 Highway 10 in Dundalk, and Cushman & Wakefield ULC for the other seven addresses, per the Notice of Motion, Motion Record of the Receiver, Sept. 30, 2026, Tab 1, paras. 1, 9–10.
On both sides of Highway 10
Two of the addresses face each other across Highway 10. The one at 772288 Highway 10, in Dundalk, is about 99.4 acres with a single house on it, and it is the subject of a proposed residential development of 804 low-rise units, a mix of detached and semi-detached single-family dwellings and townhouses. Across the highway, 159135 Highway 10, in Melancthon, is about 45 acres, also with a house, per the First Report of the Receiver, Sept. 30, 2026, para. 9(c)–(d). Both belong to Dundalk Mixed Use Expansion One Inc., against which the receiver's statutory notice of July 2 lists Dorr Capital at $14,650,565, per the Notice and Statement of the Receiver, July 2, 2026, paras. 1, 4(d).
There the appointment order puts another lender ahead of the receiver. The receiver's charge for its fees ranks behind the mortgage and other security of Farm Lending Canada Inc. registered against Dundalk Mixed Use Expansion One Inc.'s property, including the 45-acre parcel. The charge securing the receiver's borrowings ranks behind Farm Lending Canada's security on that parcel too, except for money borrowed for disbursements there of up to $2,500 each and $25,000 in all, or with Farm Lending Canada's consent, which is not to be unreasonably withheld, per the Appointment Order, June 23, 2026, paras. 17A, 20A.
Besides the Beeton house, the rest is two adjacent parcels on Braemore Street West in Dundalk, about 30.7 acres between them with a house on each; two adjacent parcels in Melancthon about 10 kilometres southeast of Dundalk, about 125 acres with a house on each; and the EcoPark, about 90 acres, roughly 50 of which are the subject of a proposed residential development, per the First Report of the Receiver, Sept. 30, 2026, para. 9(b), (e)–(f). The EcoPark "differs from the Other Real Properties in that it comprises both retail and residential components," the receiver says, per the First Report of the Receiver, Sept. 30, 2026, para. 39.
What the receiver says it has not received
The receiver asked the debtors for, among other things, creditor listings, employee records, bank information, HST account information, lease agreements, insurance policies and service provider information, and it has received some information and documentation in response. "As of the date of this First Report, the Receiver has not received a full list of creditors or the bank account details for any of the accounts held by the Debtors," the report says, per the First Report of the Receiver, Sept. 30, 2026, paras. 18–19.
On July 2 the position was much the same. The receiver's notice and statement under s. 245(1) of the BIA recorded that a complete list of creditors and other required information "has not been provided to the Receiver by the Debtors as required pursuant to S. 245(3) of the Bankruptcy and Insolvency Act and the Appointment Order," so that the only information it had was for the secured creditors it listed. The net book value of each of the eight properties is given there as "Unknown", per the Notice and Statement of the Receiver, July 2, 2026, paras. 1, 4(e). The notice went to the known creditors based primarily on what Dorr Capital had disclosed in its application record, per the First Report of the Receiver, Sept. 30, 2026, para. 27. No response from the debtors on the point is in the record read for this piece.
The notice's list sets out approximate amounts owed to "parties who appear to hold a security interest on the Debtors' assets." Against Flato Greens Inc., the EcoPark's owner, it includes Dorr Capital at $6,093,767, Realtrium Developments Corp. at a registered amount of $4,000,000, Toronto Capital Corp. at an amount given as unknown, and 43 further lines, all but two of them in individuals' names, for amounts from $25,000 to $250,000. Elsewhere it lists Dorr Capital at $5,507,882 against the two Braemore owners, at $2,463,985 with Olympia Trust Company against the two Melancthon owners and at $349,116 against Patterson Street Holdings Inc.; a numbered company at a registered $2,500,000 against one of the Melancthon owners; and three parties, Farm Lending Canada among them, against Dundalk Mixed Use Expansion One Inc., amounts unknown, per the Notice and Statement of the Receiver, July 2, 2026, para. 4(d).
Insurance, taxes and $500,000
After a notice of cancellation said the debtors' existing coverage on the properties would terminate effective July 14, 2026, the receiver arranged replacement insurance, now scheduled to expire on July 13, 2027, per the First Report of the Receiver, Sept. 30, 2026, paras. 25–26. After contacting the municipalities, it has paid all outstanding property taxes on the land, per the First Report of the Receiver, Sept. 30, 2026, paras. 28–29.
Paragraph 20 of the appointment order lets the receiver borrow up to $500,000 outstanding at any time, under a charge ranking ahead of other security but behind the receiver's own charge and certain statutory charges; borrowed money deposited for one debtor may be used only for that debtor's fees, costs and expenses unless the applicable mortgagees consent, per the Appointment Order, June 23, 2026, paras. 2A(c), 20. The receiver has borrowed $500,000 and issued receiver's certificates for that amount, per the First Report of the Receiver, Sept. 30, 2026, paras. 48–49. Its interim statement for June 23 to September 29 records the $500,000 as an advance from the applicant, secured by Receiver Certificate No. 1, alongside $14,726 of rental income and $497 of interest, for receipts of $515,223. Disbursements were $210,190, among them interest charges of $50,000, property taxes of $47,362 and insurance of $35,461, leaving an excess of receipts over disbursements of $305,033, per the First Report of the Receiver, Sept. 30, 2026, para. 50 and App. "E".
