The purpose of this One Hundred and Twenty First Report of the Monitor (the “One Hundred and Twenty First Report”) is to report to this Court on the following matters: a) consolidated cash position and liquidity of the Canadian Debtors as at September 12, 2015; b) actual receipts and disbursements of the Canadian Debtors from February 22, 2015 to September 12, 2015; c) cash flow forecast of the Canadian Debtors for the period September 13, 2015 to April 2, 2016; d) status of the Canadian Debtors’ claims process; e) status of the Canadian Debtors’ Compensation Claims Process and to provide information in support of the motion for an Order permitting the Monitor to review and adjudicate certain Compensation Claims in respect of which Form C Proofs of Claim were received after the relevant bar date; f) status of the Health and Welfare Trust (the “HWT”); g) status of the Employee Hardship Application Process and Hardship Fund and to provide information to the Court in support of a request to extend the Hardship Application Process through the stay extension period; h) status of allocation and claim matters under the Allocation Protocol approved by this Court and the U.S. Court on April 3, 2013 (the “Allocation Protocol” and all litigation and claims subject thereto, the “Allocation Protocol Litigation”); i) various other ongoing matters relevant to the CCAA proceedings; j) status of foreign proceedings; k) the Canadian Debtors’ proposed 2016 employee retention plan (the “2016 NRP”); l) the Monitor’s request for approval of the appointment of the Honourable Dennis O’Connor, Q.C., as a claims officer; and m) request for an order that the stay of proceedings be extended up to and including April 1, 2016
