The purpose of this One Hundred and Twenty Seventh Report of the Monitor (the “One Hundred and Twenty Seventh Report”) is to report to this Court on the following matters: a) consolidated cash position and liquidity of the Canadian Debtors as at February 27, 2016; b) actual receipts and disbursements of the Canadian Debtors from September 13, 2015 to February 27, 2016; c) cash flow forecast of the Canadian Debtors for the period February 28, 2016 to October 1, 2016; d) status of the Canadian Debtors’ claims process; e) status of the Canadian Debtors’ Compensation Claims Process and to provide information in support of the motion for an Order permitting the Monitor to review and adjudicate certain Compensation Claims in respect of which Form C Proofs of Claim were received after the relevant bar date; f) status of the Health and Welfare Trust (the “HWT”); g) status of the Employee Hardship Application Process and Hardship Fund and to provide information to the Court in support of a request to extend the Hardship Application Process through the stay extension period; h) status of the Termination Fund (as defined below) and to provide information in support of the order sought terminating the Termination Fund, providing a CAD 3,000 priority claim in lieu of a Termination Payment to those former employees entitled to a Termination Payment and who do not receive it, discharging the Payments Charges (as defined below) and adding CAD 16,610 (being the notional amount remaining in the Termination Fund if all former employees entitled to a Termination Payment received their Termination Payment) to the Hardship Fund, all upon the filing of a Monitor’s certificate; i) status of the allocation dispute and related claim litigation under the Allocation Protocol approved by this Court and the U.S. Court on April 3, 2013 (the “Allocation Protocol” and all litigation and claims subject thereto, the “Allocation Protocol Litigation”); j) the application of Nortel Communications Inc., Architel Systems Corporation and Northern Telecom Canada Limited filed with this court commencing proceedings pursuant to the CCAA and seeking to procedurally consolidate such proceedings with the within CCAA proceedings; k) various other ongoing matters relevant to the CCAA proceedings; l) status of foreign proceedings; and m) request for an order that the stay of proceedings be extended up to and including September 30, 2016
