The purpose of this One Hundred and Twenty Ninth Report of the Monitor (the “One Hundred and Twenty Ninth Report”) is to report to this Court on the following matters: a) consolidated cash position and liquidity of the Canadian Debtors as at September 10, 2016; b) actual receipts and disbursements of the Canadian Debtors from February 28, 2016 to September 10, 2016; c) cash flow forecast of the Canadian Debtors for the period September 11, 2016 to April 1, 2017; d) status of the Canadian Debtors’ claims process and to provide information to the Court in support of the relief sought with respect to the treatment of misfiled claims and late claims; e) status of the Health and Welfare Trust (the “HWT”); f) status of the Employee Hardship Application Process and Hardship Fund and to provide information to the Court in support of a request to extend the Hardship Application Process through the stay extension period; g) status of the allocation dispute (the “Allocation Dispute”) and claim litigation under the Allocation Protocol approved by this Court and the U.S. Court on April 3, 2013 (the “Allocation Protocol” and all litigation and claims subject thereto, the “Allocation Protocol Litigation”); h) various other ongoing matters relevant to the CCAA proceedings; i) status of foreign proceedings; j) the Canadian Debtors’ proposed 2017 employee retention plan (the “2017 NRP”); and k) request for an order that the stay of proceedings be extended up to and including March 31, 2017
