The purpose of this Supplement to the One Hundred and Twenty Fifth Report of the Monitor ("Supplemental Report") is to respond to the cross-motion of Frank Dunn ("Dunn") returnable February 1, 2016, seeking: (i) an Order approving and authorizing Dunn's use of the documents produced to him by way of the Crown's disclosure in the proceeding styled R. v. Dunn, Beatty, and Gollogly (the "Criminal Proceeding"), in accordance with D.P. v. Wagg, [2004] O.J. No 2053 (C.A.) (the "Wagg Motion"); and (ii) an Order implementing a Litigation and Discovery Plan for the hearing of the Dunn claim dispute in the form attached as Appendix "B" to Dunn's motion record
