The purpose of this eighty-ninth report of the Monitor (the “Eighty-Ninth Report”) is to report to this Court on the following matters: a) consolidated cash position and liquidity as at October 13, 2012; b) actual receipts and disbursements from July 1, 2012 to October 13, 2012; c) cash flow forecast for the period from October 14, 2012 to February 2, 2013; d) status of the Applicants’ claims process and cross-border claims matters; e) consolidated Canadian entities’ net intercompany position by region; f) status of the Compensation Claims Process; g) the Monitor’s motion for an Order permitting the Monitor to review and adjudicate certain Compensation Claims in respect of which Requests for Corrections or Form C Proofs of Claim were received after the applicable bar date ; h) status of same/overlapping Compensation Claims; i) status of the Health and Welfare Trust (“HWT”); j) status of the Termination Fund; k) status of the Hardship Fund and Process for Application for Hardship Payments; l) the Applicants’ request to extend the Employee Hardship Application Process through the stay extension period and amend the Eligibility Requirements and the Procedure with Respect to Hardship Payments Applications, accordingly; m) status of allocation matters and mediation; n) status of environmental matters; o) other matters; p) status of foreign proceedings; q) Applicants’ proposed 2013 employee retention plan (“Nortel 2013 Retention Plan”); and r) the Applicants’ request for an order that the stay of proceedings be extended up to and including February 2, 2013
