The purpose of this Ninety-Seventh Report of the Monitor (the "Ninety-Seventh Report") is to support the Monitor's motion for the approval of the Deposition Protocol (the "Deposition Protocol") that is appended to and forms part of the Stipulation Regarding EMEA Motion for Extension of Schedule (the "Stipulation") that together are the basis for the Monitor's support for the EMEA Debtor's proposed (now further) amended Litigation Timetable
