The purpose of this Ninety-Eighth report of the Monitor (the “Ninety-Eighth Report”) is to report to this Court on the following matters: a) consolidated cash position and liquidity of the Applicants as at October 12, 2013; b) actual receipts and disbursements of the Applicants from April 14, 2013 to October 12, 2013; c) cash flow forecast of the Applicants for the period October 13, 2013 to February 1, 2014; d) status of the Applicants’ claims process and cross-border claims matters and provide information to the Court in support of the motion for an Order with respect to the treatment of a misfiled claim; e) status of the Compensation Claims Process; f) provide information to the Court in support of the motion for an Order permitting the Monitor to review and adjudicate certain Compensation Claims in respect of which Form C Proofs of Claim were received after October 12, 2012; g) provide information to the Court in support of the Applicants’ motion for an Order approving a settlement agreement dated October 17, 2013 entered into between the Applicants, Monitor, Flextronics Telecom Systems Ltd. (“FTSL”), Flextronics (Canada) Inc. (“FCI”, together with FTSL, “Flextronics”) and Former Employee Representatives (collectively, the “Flextronics Claims Settlement Parties”) regarding claims related to post-retirement benefits to former Nortel employees transferred to Flextronics as part of an asset purchase transaction in 2004 (the “Flextronics Claims Settlement Agreement”); h) status of the Health and Welfare Trust (“HWT”); i) status of the Termination Fund; j) status of the Employee Hardship Application Process and Fund and provide information to the Court in support of the motion with respect to a request to extend the Hardship Application Process through the stay extension period; k) status of allocation and claims litigation pending under the Allocation Protocol approved by this Court and the U.S. Court on April 3, 2013 (the “Allocation Protocol” and all litigation and claims subject thereto, the “Allocation Dispute”); l) termination of share register and transfer agent services; m) other matters; n) status of foreign proceedings; o) the proposed 2014 employee retention plan (“2014 NRP”); and p) request for an order that the stay of proceedings be extended up to and including January 31, 2014
