The purpose of this One Hundred and Thirteenth Report of the Monitor (the “One Hundred and Thirteenth Report”) is to report to this Court on certain agreements reached by NNL in connection with resolving NNL’s obligations with respect to environmental matters at its former property at 700 Gardiners Road in Kingston, Ontario (the “Kingston Property”), in particular: a) an Amended & Restated Kingston Property Settlement Agreement among Taggart (Gardiners) Corporation (“Taggart”), NNL and the Monitor dated January 23, 2015 (the “Amended Kingston Settlement”); and b) an Agreement re: Kingston Property Settlement and Nortel ERT Proceedings among NNL, the Monitor and Her Majesty the Queen in Right of Ontario as represented by the Minister of the Environmental and Climate Change (the “MOE”) dated February 25, 2015 (the “MOE Agreement”)
