Williams Telecommunications Corp. is in receivership under BIA s. 243, commenced on the application of Bank of Montreal as senior secured creditor, with the appointment order dated May 19, 2022. As at that date, BMO's secured claim stood at approximately $2 million, comprising an Operating Loan of approximately $1.7 million (75% guaranteed by Export Development Canada) and a HASCAP Loan of approximately $250,000 (guaranteed by the Business Development Bank of Canada). The Canada Revenue Agency holds deemed trust claims ranking ahead of the Bank's security: $25,055.53 in unremitted HST for February through April 2022, which the Receiver intends to reduce through an HST adjustment and an anticipated income tax refund before remitting, and $1,948.98 for unremitted payroll deductions, of which the $1,713.28 deemed trust portion has already been paid.
The officer filed a report. The Company had already ceased operations before the receiver's appointment, and the Receiver liquidated remaining inventory and equipment through an online auction, collected accounts receivable, and is now completing final administrative and tax matters prior to seeking its discharge.
