The EBF Group Ltd. remains under CCAA protection, with an order made July 23, 2026 and the stay extended to November 30, 2026. The proceedings began May 13, 2026, after demands from two of the company's three secured lenders: counsel for 1968328 Ontario Inc. delivered a notice of default and a BIA s.244 notice of intention to enforce security on December 10, 2025, and Brian Vyner demanded payment on December 17, 2025 before applying on April 21, 2026 for a receiver under s.243, supported by 196. Fred Hageman's Holdings Limited supports the CCAA route. Unaudited entity-level figures as at March 31, 2026 show assets of $28,002,409 against liabilities of $28,499,477, including approximately $5.2 million unsecured. An independent review of the lenders' security is not complete.

Case update
EBF Group: the lenders settle, and the Monitor seeks the directors' powers
Under a September 15 settlement, EBF's three secured lenders accept MNP's entitlement findings as modified, with the first $250,000 of JNR proceeds to 1968328 Ontario. MNP's motion, returnable October 30, seeks interim distributions after $1,264,000 of reserves, a stay to March 31, 2027 and, for itself, powers EBF's directors or officers could otherwise exercise.
Case update
EBF Group: one trust clause, two answers
MNP's entitlement report finds no enforceable debt appears owed to the first-registered Paatz 2016 Family Trust, holds that Fred Hageman's Holdings' Summit participation fails the test for a trust, and treats JNR enforcement proceeds as likely its beneficial property. Brian Vyner and 1968328 Ontario disputed the JNR finding on September 4.

The EBF Group is a lender, and the fight in its CCAA is not with its borrowers but among its own secured creditors. On July 23 Justice Steele approved a timetable that gives them until 5 p.m. on September 4 to dispute the Monitor's findings — or lose the right to.
