Ted Baker Canada Inc., Ted Baker Limited, OSL Fashion Services Canada Inc. and OSL Fashion Services, Inc. have been under the Companies' Creditors Arrangement Act in the Ontario Superior Court of Justice since April 24, 2024, with Alvarez & Marsal Canada Inc. as monitor. CIBC is the senior secured lender under a credit agreement dated March 14, 2023 and amended August 3, 2023 and April 24, 2024, providing revolving loans of up to $36.5 million secured in Ontario, Quebec, Alberta, British Columbia, Nova Scotia and Manitoba. The initial order created an interim lender's charge for borrowings not exceeding $7 million, ranking behind only the administration charge, and a DIP term sheet dated May 1, 2024 added a super-priority charge securing a facility of up to $28 million. OSL Retail's $10 million secured promissory note is postponed to CIBC.
