SecureCare Capital Inc. remains in an active Division I proposal under the Bankruptcy and Insolvency Act before the Ontario Superior Court of Justice, court file 31-2278725, commenced December 20, 2021. Its obligations include $7,270,784 of secured bonds issued under a September 30, 2016 offering memorandum, secured over all of SecureCare's assets, and unsecured April 30th Bonds of $78,156,153; TFS, the collateral manager, demanded a further $12,045,761 in 2015 and 2016 operating expenses by letter of June 5, 2017, a disputed claim that had not been adjudicated. At meetings held March 14, 2018 the secured class voted $7,950,830 for and $55,000 against, and the unsecured class $37,108,826 for and $12,068,742 against. Dividends of $32,622,006.00, or 34.99 cents per dollar, were paid on $93,198,888 of proven unsecured claims filed by 2,086 bondholders, as at the Final Dividend of December 9, 2019.
