Portofino Corporation has been under court-appointed receivership in the Ontario Superior Court of Justice since October 29, 2013, when Bank of Montreal obtained the appointment of BDO Canada Limited as Receiver under section 243(1) of the Bankruptcy and Insolvency Act and section 101 of the Courts of Justice Act; section 248 of the Ontario Business Corporations Act is also invoked in the proceeding. The matter carries court file numbers CV-13-29866, CV-13-19866 and 05-CV-5864CM. A $1,000,000 mortgage in favour of Remo Valente Real Estate (1990) Limited, registered as instrument CE297353 in Land Registry Office (Essex) No. 12 on October 12, 2007, was ordered discharged and expunged from title on motion. Bank of Montreal has posted a $2,000,000 letter of credit in favour of Remo Valente Real Estate (1990) Limited as security for the judgment in the Valente court action.
