New Age Granite and Marble Ltd., its Montréal affiliate New Age Granite & Marble (Montreal) Ltd., Tile Giant Ltd. and Tile Giant Burlington Inc. have been in court-appointed receivership in Ontario under s. 243 of the BIA and provincial Judicature Act authority since November 4, 2025. Royal Bank of Canada, which holds a September 17, 2022 general security agreement from New Age Granite & Marble, corporate guarantees from the three other entities and an October 19, 2022 movable hypothec registered in Quebec against the Montréal company, demanded payment by letters dated February 7, 2025 of CAD $2,167,588.13 and USD $6,443,800.12 owing as at February 4, 2025, exclusive of legal fees, disbursements and accruing interest. Directors gave personal guarantees of $500,000 each. The Canada Revenue Agency filed HST deemed-trust proofs of claim dated November 12, 2025 for periods ending July 31, 2025 — $305,803.17 against New Age Granite & Marble and $182,440.24 against Tile Giant. Revenu Québec's priority claim against the Montréal entity remained outstanding as of the receiver's first report.
The court granted an approval and vesting order for the sale to the Debtors' right, title and interest in and to the assets described in the Auction Agreement (the "Auction Assets"). Closing terms, as extracted: upon delivery of a receipt for payment in full by the Auctioneer to each of the respective Purchasers, all right, title and interest vests absolutely.
