Harwell Hesco Electric Supply Co. Limited has been under court-appointed receivership since March 2, 2009, when the Ontario Superior Court of Justice (Commercial List) appointed Deloitte & Touche Inc. as Receiver on the application of HSBC Bank Canada, which holds first priority over the Company's assets, in file CV-09-8035-00CL. The Receiver's interim statement under s. 246(2) of the BIA, covering March 2 to August 31, 2009, reported receipts of $2,401,614.08 less a $39,832.46 s. 81.4 super-priority wage claim paid to employees, disbursements of $365,391.93 and an excess of receipts over disbursements of $1,996,389.69. Fourteen creditors had registered security against the Company's assets; five others had filed proofs of claim and no distributions had been made to any secured creditor. Unrealized property included the $480,000 balance of Danbury Industrial's $840,000 net minimum guarantee, which Danbury has refused to pay and is litigating. The proceeding is closed.
