Elliott Gerstein

Elliott Joel Gerstein remains subject to active bankruptcy proceedings under the Bankruptcy and Insolvency Act before the Ontario Superior Court of Justice, court file no. 31-454726. The mailing list of known creditors filed with his notice of intention on February 20, 2007 identified the Canada Revenue Agency at $4,238,057.00 as a deemed trust class claim, Brenthall Apartments Limited at $1,283,028, and numerous apartment and development entities, several associated with Sharon Gerstein. On October 12, 2007 Brenthall obtained summary judgment for $1,283,028, declared to arise from fraud under s. 178(1)(d) of the BIA and therefore not released by discharge. The trustee's supplementary report of March 11, 2020 put unsecured claims filed in the estate at $11,493,646.63 apart from the CRA, whose claim was then stated at $5,002,113.92, a combined $16,495,760.55.
