Dunsire (Landsdown) Inc., operating as White Cedar Estates, is in court-appointed receivership. RSM Canada Limited (formerly Collins Barrow Toronto Limited) was appointed receiver on December 6, 2017, on the application of MarshallZehr Group Inc., under subsection 243(1) of the Bankruptcy and Insolvency Act and section 101 of the Courts of Justice Act (court file CV-17-587118-00CL). As at December 6, 2017, assets were reported at CAD 5,942,170, including land valued at CAD 2,180,000. MarshallZehr Group Inc. holds a secured claim of CAD 4,535,160 and Fortress CAD 1,731,000, and the largest unsecured claim is Kieswetter Excavating Inc. at CAD 1,079,285.86. The receivership is active.
The court granted an approval and vesting order for the sale to Aquicorp Inc. Closing terms, as extracted: Vesting effective upon delivery of Receiver's Certificate confirming payment of Purchase Price and satisfaction of closing conditions.
The officer filed report no. First Report of the Receiver. The Receiver has focused on clearing Draft Plan conditions for the Guelph residential development and marketing the Real Property. It received two offers by the bid deadline, and entered into an agreement of purchase and sale with a company owned by the Debtor's principal, for which it now seeks court approval.
