Creative Homescapes Inc., with 1974592 Ontario Inc. and 1646395 Ontario Inc., was the subject of a court-appointed receivership under s. 243 of the BIA in the Ontario Superior Court of Justice (In Bankruptcy and Insolvency), court file CV-24-00034048-0000; the proceeding is closed. The Toronto-Dominion Bank held senior security under general security agreements dated March 3, 2023 from all three debtors, plus cross-guarantees and a personal guarantee of Shawn Kelly limited to $200,000, and issued demands and a BIA notice on September 12, 2024 for $2,056,906.05 as of September 10, 2024, exclusive of legal fees, disbursements and accruing interest. CertainTeed Canada and Wells Fargo Capital Finance, whose registrations predate TD's, had subordinated to TD in March 2023. Creative assigned into bankruptcy on February 9, 2026, which the Receiver states renders the CRA's $193,442.12 HST debt unsecured.
