Bella Senior Care Residences Inc., an Ontario company proceeding under Division I of the Bankruptcy and Insolvency Act, remains in an active proposal in which a disputed unsecured claim is now before the court. Claire Annis & Associates Inc. (ClaireCo) filed a proof of claim with the Proposal Trustee for $66,274.50, an amount it supports by a statement of account showing that balance as of invoicing through November 30, 2017. The Trustee disallowed the claim in whole by Notice of Disallowance dated July 9, 2019, taking the position that there was no contractual relationship or purchase order between the parties and no history of direct invoicing or payment. ClaireCo has moved to appeal the disallowance, calling it untrue and seeking an order declaring its claim valid.
