Almenara En El Rio Inc. has been under court-appointed receivership since April 20, 2023, when the Ontario Superior Court of Justice appointed BDO Canada Limited receiver and manager under section 243(1) of the Bankruptcy and Insolvency Act and section 101 of the Courts of Justice Act, in Court File No. CV-23-00011162-0000. The application was brought by Elliot Lake and North Shore Corporation For Business Development and East Algoma Community Futures Development Corporation/Algoma Est Societe D'aide Au Developpement Des Collectivites, which had served a Demand Notice and Notice of Intention to Enforce Security dated April 12, 2023, claiming $153,061.73 and $125,318.81 respectively, plus unquantified interest, legal fees, disbursements and other expenses. Their security dates to May 2011 charges over the property and general security agreements, ranking pari passu under a May 3, 2011 agreement. The Corporation of the Town of Spanish registered a tax arrears certificate against the property on February 26, 2020 for $31,506.27 as at December 31, 2019. The receivership remains active.
