Albert's Marina has been under court-appointed receivership since October 5, 2012, when the Ontario Superior Court of Justice appointed SF Partners Inc. as receiver under section 101 of the Courts of Justice Act on the application of Teddy Wyszatko, in Court File No. CV-10-101277-00. The Royal Bank of Canada, which holds a collateral charge over the land the marina occupies, served a notice of intention to enforce security under section 244(1) of the Bankruptcy and Insolvency Act on November 29, 2012, claiming approximately $134,000. An independent legal opinion confirmed the validity of that security. The bank had preliminarily agreed to stand down before seeking repayment.
The court appointed SF Partners Inc. as receiver of Albert's Marina the same day, under section 101 of the Courts of Justice Act.
