9408-7129 Québec Inc. has been under court-appointed receivership since February 5, 2025, following Banque Laurentienne du Canada's January 27, 2025 application for the appointment of a receiver on an unpaid claim of more than $27 million. BLC holds first-rank security over the Immeubles at 3454-3458 avenue du Musée and the universality of movables needed to operate them, and states a balance of at least $26,815,880.87 as of January 14, 2025, subject to adjustment; the debt is also backed by personal guarantees from Robbie Peck and Paolo Presti and corporate guarantees from Place Dorée and Placements Presti dated August 30, 2022. As of June 10, 2025, an independent legal opinion from Stikeman on the validity and opposability of BLC's security remained in progress, and the validity of construction hypothecs registered by 9388-9012 Québec inc., Prestico, Presti Demeures and Alauda Construction had not been determined, with a $400,000 reserve being transferred to a residual company pending that determination. Westmount Capital, Horizon Capital and Gestion Immobilière Place Dorée rank as second-rank secured creditors behind BLC.
The officer filed report no. Rapport définitif du séquestre. The receivership over the debtor's real estate has concluded following the sale of the Immeubles; the Receiver has resolved disputed construction legal hypothecs and is now seeking court approval for final distributions to the secured creditor before being discharged.
