6413340 Canada Inc. and 7149816 Canada Inc., operating as Esso, were placed in a court-appointed receivership commenced February 1, 2018 in the Ontario Superior Court of Justice under BIA s. 243 and provincial Judicature Act authority; the proceeding is closed. Bank of Montreal, the sole registered secured party under general security agreements dated January 24, 2011, demanded payment on May 14, 2015 of $1,410,045.76 from Al-Cheragh International Corporation, $192,028.27 from 6413340 and $10,020.70 from 7149816 for an unauthorized overdraft caused by cheque kiting. The Bank also held mortgage SC899724, registered May 5, 2011 in the principal amount of $1,725,000 at prime plus 5%, due on demand. Ranking behind that mortgage were a Minister of National Revenue lien of $24,253 and a Snap Commercial Finance Corp. registration of $10,320. A CRA garnishment for $121,133 in HST arrears froze 6413340's operating account.
