The purpose of this Ninety-Sixth report of the Monitor (the “Ninety-Sixth Report”) is to support the U.S. Debtors’ request for recognition in Canada of the U.S. Order for Issuance of Letters Rogatory dated July 16, 2013 pursuant to section 18.6 of the CCAA allowing for evidence to be obtained for purposes of the trial set to commence on January 6, 2014 to determine (a) allocation of sales proceeds; (b) claims of the EMEA Debtors against the Canadian Debtors (and others) and the U.S. Debtors; and (c) claims of the UK Pension Claimants against the Canadian Debtors and the U.S. Debtors
